Terms of Service

Thank you for choosing DeepWave’s online service! DeepWave Co., Ltd. ( DeepWave) provides our service according to DeepWave’s term of service (Term). Please read this Term carefully and make sure you understand it. If you do not understand the Term, or do not accept any part of this agreement, you may not use DeepWave’s service.

If you are considered a minor in your country, you represent that you have your parent or guardian’s permission to use the Service. Please have them read this Agreement with you.

If you are a parent or legal guardian of a minor in your country, by allowing your child to use the Service, you are subject to the terms of this Agreement and responsible for your child’s activity on the Service.

Definitions

  • Software - means the softwares and applications developed by DeepWave, including but not limited to the update versions and following auxiliary or additional software or applications.
  • User - means the person who agreed to this Term and used DeepWave’s service whether they have finished the membership registration process.
  • Member - means the user who has finished the membership registration process.
  • Account - means the identification (including the password) given by DeepWave after DeepWave verified the user’s personal information and finished the registration. Members are required to log in before accessing DeepWave’s Service and software.
  • Payer - means the person who add value to our system and/or using DeepWave’s any paid goods or services. The Payer can be the user themself, their legal representative, or an authorized third party.
  • Content - means the subjects provided by DeepWave, including but not limited to games, information, communications, goods, word, pictures, videos, audios, graphics, and music.
  • Content Provider - means the people and/or companies provide foregoing content to DeepWave and its users under a content supply agreement.
  • DeepWave Service - means the functions provide by DeepWave via the Internet, applications, and/or softwares, including but not limited to searching, playing, downloading, community, and other developing features. The actual service items are subject to the announcement on DeepWave’s website.
  • Period - means the time period during the user use or pay DeepWave service.
  • Download - means the user store the DeepWave anlysis result in their device.

User’s Liability and Responsibility

You are welcome to enjoy the software and the service provided by DeepWave. However, DeepWave reserves the right to suspend or terminate your access to the services or delete your DeepWave account if any of these things happen:

  • you materially or repeatedly breach DeepWave’s Term of Service.
  • we’re required to do so to comply with a legal requirement or a court order.
  • we reasonably believe that your conduct causes harm or liability to a user, third party, or DeepWave — for example, by hacking, phishing, spamming, or scraping content that doesn’t belong to you.

When using the DeepWave service, you can send, publish or upload content on our website or software, including but not limited to text, pictures, photos, links, images, playlists, video, and audio. You assure that the content provided by you is original and/or involves in any infrindgement. You are responsible for the consequences of the content you transmit, publish or upload.

If DeepWave is informed that the content you send, publish or upload violates the intellectual property rights of others, DeepWave has the right to delete the content and reserves the right to delete content without prior notice.

The DeepWave service is for personal use only. If you use the DeepWave service in public or in other public ways, please obtain the relevant public broadcast, public transmission, public performance and other rights from the content provider. Otherwise, you shall bear the relevant legal responsibilities if you do not obtained the aforementioned rights of use.

When using DeepWave services or software, you should abide by relevant laws and regulations, and you MUST not engage in the following behaviors:

  • Reproduce, change, sell, license, transfer or use DeepWave services or software content for any illegal purposes;
  • Send or publish advertising text, links and pictures in the name of DeepWave without DeepWave's written consent;
  • Any modification, restoration engineering, reverse encoding of the software, simplifying it into an understandable form or reverse assembly translation, preventing or hindering other users from enjoying the software and DeepWave services;
  • Make false reports or objections; or other behaviors that DeepWave considers a violation to this clause.

Obligation to provide authentic information

If you decide to register as a member, you agree to fill in authentic personal information. You may update your information on our website at any time. If the personal information you fill in is fabricate, or if there is any misleading, DeepWave has the right to suspend or terminate your membership and the use of the DeepWave service at any time. If the false information causes damage(s) to the rights of DeepWave and/or a third party, you will be responsible for the relevant legal responsibility.

Obligation to Keep Your Account Safe

Your account is for your own use only. You can only use DeepWave services, software and content in accordance with This Term, and may not illegally reproduce, distribute, sell, publicly transmit or otherwise use it to other third parties.

You are obliged to keep the DeepWave’s member account, password and other related information, and are responsible for all activities and behaviors performed after the member account logs in to the system, including but not limited to related expenses.

If you find that the member account has any abnormal activities, you should immediately inform DeepWave and protect your personal rights through appropriate legal channels. DeepWave also reserve the right to manage the use of the disputed account.DeepWave will ask for relevant personal information if necessary.

If DeepWave’s rights and interests were voilated due to user’s consent to the use of your member account by a third party, the user shall be responsible for the relevant laws and/or liability for damages.

DeepWave may take any necessary measures to prevent the user from using software and services in a manner prohibited by the DeepWave’s relevant provisions or laws.

Privacy and Personal Data Protection Policy

At DeepWave, we take your privacy very serious. Still, to protect your rights, please read our company's <Privacy Policy> in full.

Also, we would like to remind you that:

  • Do not exchange personal information or private information with untrusted others.
  • Avoid using public computers or share computers with others if not nesassary.
  • Log out your account and delete your personal information after use a public computer.

Intellectual Property Policy

The intellectual property of DeepWave’s service, software, content, text, and other materials is belonged to DeepWave and/or licenced third parties. DeepWave only grants the right of use to the user. DeepWave hereby reserves all rights not expressly granted to you.

DeepWave’s services, software, content, and technologies are protected by the relevant laws and regulations of each authorized region. You may not remove or change any copyright electronic management information, anti-theft measures, or other rights (including and not limited to patent rights and trademark rights) or software markings.

Payment

When you pay to use the DeepWave service, you agree to following terms:

  • DeepWave accepts credit cards as major payment in our service and software. Other payment methods will be negotiated separately.
  • You agree to authorize the company to debit the credit card account you specify in accordance with the service content and deduction method you choose.

DeepWave use the transcation service provided by NewebPay. For the transaction related terms and conditions, please read their <Terms of Service> and <Frequent Asked Questions>.

Other Conditions

Limitation of Liability

Any DeepWave provided information, content, software function or service is only available with the current functions and conditions of each service. DeepWave does guarantee the qualitiy and the completeness of the information, content, software function and/or service under the impact of disconnection, delay, or communication-related defects.

DeepWave and its licensors shall not be liable for any damages, including:

  • losses caused by the use or inability to use DeepWave’s software or services;
  • other direct, indirect, accidental, special, contingent losses (including but not limited to damage or loss of business profits, business interruption, loss of business information, and any other monetary losses).

DeepWave shall not be liable for any damages and damages caused by the intention or negligence of third-party service providers and other users.

Modification

DeepWave reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately. Please check the latest information posted herein to inform yourself of any changes.
